MedVault Terms of Service
Last Updated: September 1, 2026
These Terms of Service ("Terms") govern your use of the MedVault mobile application and related services (the "App") operated by MedVault ("MedVault," "we," "us," or "our").
MedVault is a personal health information organization and record-keeping tool designed to help individuals store, organize, manage, and share health information they choose to enter or upload.
By creating an account or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, do not create an account or use the App.
1. Eligibility and Your Account
You must be at least 13 years old to create an account or use the App.
If applicable law requires a higher minimum age for use of the App, that requirement will apply.
You are responsible for:
- Providing accurate information when creating your account.
- Keeping your account information reasonably up to date.
- Maintaining the confidentiality of your account credentials.
- Maintaining appropriate security on the devices you use to access MedVault.
- All activity that occurs through your account, except activity resulting from unauthorized access that was not caused by your failure to protect your credentials or device.
You agree to notify MedVault promptly if you believe your account has been accessed or used without authorization.
2. Personal Use and License
Subject to these Terms, MedVault grants you a limited, non-exclusive, non-transferable, revocable license to access and use the App for your personal, non-commercial purposes.
Unless otherwise stated at the time of purchase, MedVault is offered under a single-device license.
When you purchase a license, you receive the right to install and use the App on one supported device for your personal use.
You may not:
- Share, resell, sublicense, or transfer your license.
- Use one license simultaneously across multiple unauthorized devices.
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App, except where such restriction is prohibited by applicable law.
- Copy, reproduce, modify, distribute, or create derivative works of the App except as expressly permitted by these Terms or applicable law.
- Use the App for any unlawful purpose.
- Use the App in a manner that could damage, disable, overburden, or impair the App or its infrastructure.
- Attempt to gain unauthorized access to another user's account, records, systems, or data.
Installing or using the App on an additional device may require an additional license where applicable.
3. The MedVault Service
MedVault provides tools that allow you to store, organize, review, and share health information that you choose to enter or upload.
Depending on the features available, the App may allow you to:
- Store medical documents and records.
- Organize health information.
- Process uploaded documents using OCR or automated extraction.
- Generate summaries or organized health information.
- Create transfer packets.
- Create emergency summaries.
- Share information with recipients you select.
MedVault does not independently verify the accuracy, completeness, or current status of information you enter or upload.
We may update, modify, add, suspend, or discontinue features of the App at any time.
We strive to keep the App available and functional but do not guarantee that the App will always be available, uninterrupted, secure, or error-free.
4. Your Content
Information, documents, records, images, text, or other materials that you enter, upload, store, or otherwise submit through the App are referred to as "Your Content."
You retain your rights to Your Content.
MedVault does not claim ownership of Your Content.
You grant MedVault a limited license to host, store, process, reproduce, transmit, and otherwise use Your Content only as reasonably necessary to provide, maintain, secure, and improve the functionality of the App, comply with applicable law, prevent fraud or abuse, and perform other purposes described in our Privacy Policy.
You represent that you have the legal right and authority to upload, store, and share Your Content through MedVault.
You are responsible for reviewing Your Content before relying on it or sharing it with another person or organization.
Personal Identifiers
Documents uploaded to MedVault may contain personal identifiers, including names, dates of birth, medical record numbers, addresses, insurance information, or other identifying information.
MedVault does not require you to provide many of these identifiers as part of account registration. However, MedVault cannot prevent a user from uploading a document that contains such information.
You should consider removing or redacting unnecessary sensitive identifiers before uploading documents, including:
- Social Security numbers
- Credit or debit card numbers
- Bank account or routing numbers
- Driver's license or passport numbers
- Other government-issued identification numbers
- Other financial account information
You are responsible for reviewing documents before sharing them through the App.
Patient Jacket Code
MedVault may assign your account a unique patient jacket code to help organize and identify your records.
The patient jacket code is intended to reduce the need to use unnecessary personal identifiers when organizing or transferring information.
A patient jacket code does not replace a legal identifier when a healthcare provider, facility, insurer, or other recipient requires one.
5. Automated Processing and Artificial Intelligence
MedVault may use automated technologies, including optical character recognition (OCR), machine-learning tools, artificial intelligence-assisted extraction, or similar technologies, to process information contained in documents you choose to upload.
These technologies may be used to identify, extract, organize, or categorize information such as:
- Medications
- Allergies
- Laboratory results
- Surgeries
- Medical conditions
- Provider information
- Other information contained in uploaded documents
Uploaded documents and extracted information may be processed by third-party technology providers that support these features.
MedVault does not intentionally use the contents of your personal medical records to train general-purpose artificial intelligence models unless that practice is specifically disclosed to you and any consent or authorization required by applicable law is obtained.
Automated processing may produce inaccurate, incomplete, or incorrect results.
You are responsible for reviewing automated results before relying on them for any purpose or sharing them with another person or organization.
6. Sharing and Transfer of Information
MedVault may allow you to create, download, transmit, or otherwise share information that you select.
You are responsible for:
- Reviewing the information selected for sharing.
- Confirming that the recipient is appropriate.
- Removing personal identifiers you do not wish to share.
- Confirming that the information is accurate and complete enough for the intended purpose.
Once you intentionally share information with another person, healthcare provider, facility, or other recipient, that recipient may handle the information according to its own privacy practices, policies, and legal obligations.
MedVault is not responsible for how a recipient uses information after you choose to share it with that recipient, except to the extent required by applicable law.
Electronic communication and sharing carry inherent risks. No electronic transmission or storage system can be guaranteed to be completely secure.
7. Third-Party Services
MedVault may use third-party service providers to operate and support the App.
Depending on the features you use, these providers may assist with:
- Cloud hosting and infrastructure.
- Authentication and account management.
- Database services.
- Document storage.
- OCR and document processing.
- Automated information extraction.
- Security and monitoring.
- Technical support.
- Payment processing.
- Other services necessary to operate the App.
Third-party providers may process information on MedVault's behalf as necessary to provide their contracted services.
We seek to configure and use third-party services in a manner consistent with our Privacy Policy and applicable law.
Third-party providers may have their own terms, privacy policies, security practices, and data-retention practices.
8. Privacy and Healthcare Information
Your use of MedVault is also governed by our Privacy Policy, which explains how we collect, use, store, process, share, retain, and delete information.
MedVault is designed as a personal health information organization and record-keeping service.
MedVault does not represent or market itself as "HIPAA certified."
Whether HIPAA applies to information processed through MedVault depends on the circumstances, including the relationship between MedVault, healthcare providers, health plans, and other organizations.
MedVault may be subject to other federal, state, or international privacy and data-protection laws depending on how the App is used and where users are located.
Nothing in these Terms is intended to represent that MedVault is exempt from any applicable privacy or data-protection law.
9. Security and Data Protection
MedVault uses administrative, technical, and organizational safeguards designed to protect information from unauthorized access, use, alteration, or disclosure.
Depending on the applicable system or service, these safeguards may include:
- Encryption of health information in transit.
- Encryption of health information at rest.
- Secure connections between your device and MedVault services.
- Account-level access controls.
- Authentication and authorization controls.
- Measures designed to prevent unauthorized access to another user's information.
- Security monitoring and technical safeguards.
No method of electronic storage or transmission is completely secure.
You acknowledge that electronic communications, data storage, document processing, and information sharing carry inherent risks, including the possibility of unauthorized access or data breaches.
You are responsible for maintaining the confidentiality of your account credentials and using reasonable security measures on your device.
10. Health Data Security Incidents
If MedVault experiences a security incident involving health information, we will investigate the incident and determine whether notification is required under applicable federal or state law.
Depending on the circumstances, applicable requirements may include the Federal Trade Commission's Health Breach Notification Rule, state data-breach notification laws, or other applicable requirements.
Where required by law, MedVault will provide notice to affected individuals and governmental authorities within the timeframe and in the manner required by applicable law.
11. Acceptable Use
You agree not to:
- Use the App for unlawful, fraudulent, abusive, or malicious purposes.
- Store or share information that you do not have the legal right or authorization to store or share.
- Attempt to access another user's account or information.
- Attempt to bypass authentication or security controls.
- Interfere with the proper operation of the App or its infrastructure.
- Introduce malware, viruses, ransomware, or other malicious code.
- Attempt to reverse engineer or exploit vulnerabilities in the App.
- Use the App to violate another person's privacy or legal rights.
- Use the App to impersonate another person or organization.
- Use the App in a manner that could reasonably harm MedVault, its users, or third-party service providers.
We may investigate suspected violations of these Terms and take appropriate action, including restricting or terminating access where appropriate.
12. Payments and Purchases
MedVault may offer a one-time license, subscription, paid feature, or other paid service.
Payments may be processed through a designated third-party payment provider.
We do not intentionally collect or store your complete payment card number when payment processing is handled by a third-party payment provider.
Unless otherwise required by applicable law or expressly stated at the time of purchase, fees are non-refundable.
If MedVault changes its pricing structure, we will provide notice where required by applicable law.
Purchases may also be subject to the terms and policies of the applicable app store or payment provider.
13. No Medical Advice
MedVault is a personal health information organization and record-keeping tool.
MedVault is not a medical device and does not provide medical advice, diagnosis, treatment, or clinical decision-making.
Information displayed in MedVault, including information generated or extracted using automated technologies, should not be considered a substitute for professional medical advice, diagnosis, or treatment.
You should not rely solely on MedVault or automated extraction features when making medical decisions.
Always verify important medical information with an appropriate healthcare professional or the original medical record.
If you are experiencing a medical emergency, contact emergency services or seek immediate medical attention.
14. Disclaimers of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP AND ALL RELATED SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."
MEDVAULT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, AND SECURITY, EXCEPT TO THE EXTENT SUCH WARRANTIES CANNOT LAWFULLY BE DISCLAIMED.
WE DO NOT WARRANT THAT:
- THE APP WILL ALWAYS BE AVAILABLE OR UNINTERRUPTED;
- THE APP WILL BE ERROR-FREE;
- INFORMATION STORED OR DISPLAYED THROUGH THE APP WILL ALWAYS BE ACCURATE, COMPLETE, OR CURRENT;
- AUTOMATED DOCUMENT PROCESSING WILL BE ACCURATE OR COMPLETE;
- THE APP WILL MEET EVERY USER'S PARTICULAR REQUIREMENTS; OR
- THE APP WILL NEVER EXPERIENCE A SECURITY INCIDENT OR DATA BREACH.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MEDVAULT AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, SERVICE PROVIDERS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS OPPORTUNITIES, OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEDVAULT'S TOTAL AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE APP WILL NOT EXCEED THE GREATER OF:
(a) THE AMOUNT YOU PAID TO MEDVAULT FOR THE APP DURING THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR
(b) $100.
Nothing in these Terms limits liability that cannot legally be limited or excluded under applicable law.
16. Indemnification
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless MedVault and its owners, officers, employees, contractors, affiliates, and service providers from claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:
- Your violation of these Terms.
- Your misuse of the App.
- Your Content.
- Your violation of another person's rights.
- Your unauthorized sharing or disclosure of information through the App.
This section does not require you to indemnify MedVault for MedVault's own unlawful conduct or liability that cannot legally be shifted to you.
17. Account Deletion and Termination
You may stop using MedVault or request deletion of your account at any time through available App functionality or by contacting MedVault.
We may suspend or terminate your access to the App if:
- You materially violate these Terms.
- You use the App for unlawful or abusive purposes.
- Your use presents a security risk to MedVault or other users.
- We are required to do so by law.
- We discontinue the App or a material portion of its services.
Where reasonably practicable, we may provide notice before terminating an account for a violation, but we may act immediately when necessary to protect the security of the App, our users, or others.
Upon termination, your right to use the App ends.
Termination does not automatically delete information that MedVault or its service providers are legally permitted or required to retain. Data deletion is governed by our Privacy Policy and applicable deletion procedures.
Provisions that by their nature should survive termination, including provisions concerning ownership, disclaimers, limitations of liability, indemnification, and dispute-related obligations, will survive termination.
18. Changes to These Terms
We may update these Terms from time to time.
When we make changes, we will update the "Last Updated" date at the beginning of these Terms.
If we make material changes, we may provide additional notice through the App, by email, or by other appropriate means when required or appropriate.
Your continued use of the App after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
If you do not agree to updated Terms, you should stop using the App.
19. Governing Law
These Terms are governed by the laws of the state in which MedVault operates, without regard to conflict-of-law principles, except to the extent federal law or applicable consumer-protection law requires otherwise.
Any dispute arising from these Terms or your use of the App will be handled in accordance with applicable law.
Nothing in these Terms prevents you from exercising rights that cannot legally be waived or restricted.
20. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.
21. Entire Agreement
These Terms, together with the MedVault Privacy Policy and any additional terms expressly applicable to particular features or purchases, constitute the agreement between you and MedVault concerning your use of the App.
If there is a conflict between these Terms and a separate agreement that expressly governs a particular service or transaction, the specific agreement will control to the extent of the conflict.
